The National Assembly is expected to pass a bill in June that will allow all court rulings to be posted on the Internet. A meeting of a special parliamentary committee in charge of legal reform on Wednesday is likely to give the green light to the bill, which then goes to the Legislation and Judiciary Committee and a plenary session of the National Assembly, where it is also expected to pass, a parliamentary official said Monday.
All Supreme Court rulings have been posted on its website since 2003, but access to decisions by lower courts required an application by case number and the name of the person involved or a visit to the court in person. Applications took several days to process. But once the revised bill goes into effect, all court rulings can be viewed by typing in key words.
The Korean Bar Association said rulings by lower courts need to be openly accessible so the public can see how sentences were meted out. A court official said posting them on the web would help evaluate decisions made by judges from an open and objective point of view. The U.S., Australia and Canada post court rulings on the Internet.
But the bill requires leaving out the names of plaintiff, defendants and witnesses to prevent invasion of privacy, so lawmakers are seeking to make the bill effective in 2015 considering the time it takes to make changes in the records. But critics say even if the names of the parties are removed, the circumstances of a case and the date of a ruling may be enough for others to identify them.
