Mugabe has insisted that he does not want to breach the Constitution, which provides that elections should be held on or before the life of the existing Parliament expires.
While the existing Constitution allows for the President to rule by decree after June 29 until elections are held, Mugabe has said he does not want to do that as it would not be tenable and democratic.
According to the Sixth Schedule to the new Constitution, some of its sections will come into force immediately after gazetting, particularly those dealing with elections for President, House of Assembly and Senate, provincial and metropolitan councils and local authorities.
Also coming into force immediately would be the Declaration of Rights and the provisions about the Constitutional Court with the corresponding parts of the existing Lancaster House Constitution making way to the new provisions.
The rest of the new Constitution would only come into force when the person elected as President in the coming elections is sworn into office and the existing Constitution falls away completely. In the interim, the existing Constitution would continue in partial force.
The Movement for Democratic Change (MDC) factions are demanding that Mugabe delay proclaiming dates for the elections until all provisions of the Global Political Agreement (GPA) are implemented.
Provisions of the GPA that the MDCs are demanding to be implemented include reforms of the security and media sectors.
Mugabe's Zanu PF party - the partner of the two MDC factions in the current unit government forged under the GPA - is dismissing the demands, arguing that it has fulfilled its part of the bargain and provisions of the GPA that remain to be implemented include removal of sanctions and closing of pirate radio stations beaming hate language into the country, which it claims the MDC formations caused to be effected.
